  • The leader of the majority party in the Vidhan Sabha becomes Chief Minister. If no party has a majority, a coalition government is formed.
  • The CM is chosen by members of his party or coalition, but is appointed by the Governor.
  • The CM must be a member of the state legislature or become one within six months of appointment. (Nitish Kumar, for example, was a member of the Vidhan Parishad when he became CM.)
  • The CM is the link between the Governor and the Council of Ministers, and plays the key role in administrative decisions, appointment of ministers and officers, and law-making.
  • The CM submits his resignation to the Governor. Example: Nitish Kumar resigned on 14 April 2026 after being elected to the Rajya Sabha; Governor Syed Ata Hasnain then swore in Samrat Choudhary (BJP) as CM on 15 April 2026, with Vijay Kumar Choudhary and Bijendra Prasad Yadav (JD(U)) as Deputy CMs.
